Article 1 – Definitions

Customer: Any natural person who acts for purposes that do not fall within the scope of its commercial, corporate, artisanal or professional activities and who purchases or purchases potentially products via the Website.

Contract: The remote contract between the Company and the Customer for the purchase of Products via the Website. The Contract is governed by these Terms and Conditions.

Business day: Every day except Saturday, Sunday and Belgian holidays.

Offer: The offer of Products via the Website. The Offer is governed by these Terms and Conditions.

Products: All products available for purchase on the Website.

Article 2 – Subject

2.1 Mo’vintage by its site offers for the sale of second hand clothing and accessories. Each product is inspected to offer customers an item without traces of wear. However, some defects may escape control during the inspection. The sizes indicated in the summary of each item are those on the label if the product has one and, if applicable, an estimate will be made by the company. In order to avoid confusion, the customer may find the measures of the article in his description.

2.2. The customer will receive the items he ordered as they are published on the site. However, a slight color difference is possible depending on the brightness

2.3. Each piece on the site is presented in a single copy only.

2.4.The company does everything in order not to sell counterfeit items. However, counterfeiting is an increasing phenomenon and there may be some clues that escape us.

2.5. The customer will only receive the clothes as detailed in the description. The various elements present on the photos act as decoration.

Article 3 – Applicability

3.1. These Terms and Conditions are applicable to each Offer of the Corporation and all Contracts.

3.2. These Terms and Conditions will be made available to the Customer prior to the conclusion of the Agreement between the Company and the Customer. These general terms and conditions will be made available to the Customer, at least before the conclusion of the Contract, in a manner that will enable the Customer to save them on a sustainable electronic data carrier.

3.3 Any order placed on the site shall indicate membership in the General Terms and Conditions of Sales. Any order confirmation results in your full adherence to these Terms and Conditions, without exception or reservation.

Article 4 – Training and duration of the Contract

6- The customer can make the purchase of his order by logging into his personal account Mo’vintage or as a guest.

7- The customer fills the requested coordinates for the order and supports "continue".

8- The customer informs the information requested for the delivery address and supports “continue”

9- The customer indicates the means of delivery by which he would like the company to send him the parcel and support "continue"

10- The customer chooses the payment method with which he wishes to make the payment of his order.

11- The customer makes the payment. The order is finalized.

4.1. The Contract is concluded from the time the Customer has accepted the Offer and the Terms and Conditions.

4.2. The Contract and the General Conditions will remain in force until all obligations are fulfilled.

Article 5 – price

5.1. The prices of the Products will be those indicated on the Website at the time the Customer orders.

5.2. reserves the right to change its prices at any time, but the product will be charged on the basis of the tariff in effect at the time of order validation. The products remain the property of until the full payment of the price.

5.3. All prices of the Products can be agreed without delivery costs. Delivery costs are borne by the customer. Shipping costs will depend on the country where the Products must be shipped.

5.4. Before submitting an order, the total price, all fees and taxes included, will be made available to the Customer and indicated in euros

5.5. The order will not be processed until the Company has received the Customer’s instructions within 48 hours. If the Company fails to contact the Customer using the contact information provided during the order process or if the Company receives no response from the Customer within the above-mentioned period, it will process the order as cancelled and inform the Customer in writing.

Article 6 - Payment and means of payment

6.1. The Customer can use the following payment methods to pay the Products: Bancontact, Visa and Mastercard.

6.2. The Customer must pay when ordering.

Article 7 – Shipping and Delivery

7.1. The Company undertakes to deliver the Products within 1 to 7 working days depending on the method of sending after receipt of the entire payment. If the Company is not in a position to deliver the Products within the above-mentioned deadline, it undertakes to inform the Customer in writing. In this case, the Customer will provide the Company with a new delivery time that must be reasonable. If the Company does not meet this new deadline, the Customer has the right to cancel the order.

7.2. (Option) The Customer will receive an email confirmation as soon as the order leaves the Company premises. The confirmation will contain all necessary information regarding the delivery method

7.3. The Company will deliver the order to the address provided by the Customer during the purchase process.

7.4. If no one is present at the address of the Customer at the time of delivery, the Customer must follow the instructions of the delivery service responsible for the delivery of the order.

7.5 The Company is not responsible for the damage caused during delivery.

Article 8 - Right to cancel an order before delivery

8.1. The Customer has the right to cancel the order without cause and without charge before the shipment of the order.

8.2. The Customer can cancel the order by sending an email to . After the cancellation of the order, the Customer will receive an e-mail cancellation confirmation and the Company will refund the amounts already paid on the credit or debit card used by the Customer to pay.

8.3. Upon receipt of a confirmation that the Products have left the Company’s premises (in accordance with section 7.2.), the Customer may no longer cancel the order.

8.4. If the order has not been cancelled, the Products will be delivered and the Customer will be able to return the Product according to the procedure provided for in Article 9.

Article 9 - Right of withdrawal and reimbursement

9.1. The Customer has the legal right to waive the Contract during the period provided for in Article 9.2. This means that the Customer may decide, during the period in question, not to keep the Products. The Customer must inform the Company of his decision to withdraw and receive a refund. The Customer does not have to justify his withdrawal.

9.2. The customer has 14 days to give up the contract. The start date of the withdrawal period starts from the receipt of the package by the customer.

9.3. The customer must inform the company either via the email service integrated in Mo’vintage or via email at the following address:

9.4. The customer must close the package with all the products delivered to it. This includes the item(s) purchased as well as the secondary accessories offered by the company. If the package is not complete, the refund will only be partial.

9.5. The package must be returned to the company's headquarters. Return costs are borne by the customer

9.6. The refund will be made upon receipt of the package by the company. Refund processing can take up to 10 business days.

9.7. The refund includes the price of the item(s) and the shipping costs of the first shipment of the order

9.8. If the customer wishes a partial return of his order, he must follow the same retraction process explained above. (Explanation of item 9.1 to item 9.7). However, the company undertakes to reimburse only 50% of the delivery costs of the first shipment. Return costs are borne by the customer.

11.1. The Company uses the personal information of the Customer only in accordance with the Privacy Policy of the Website.

Article 12– Applicable law

12.1. These Terms and Conditions are in French. This means that the Contracts for the Purchase of Products via our Website and any dispute or claim arising out of or relating to the Website will be governed by Belgian law.

Article 13 - Miscellaneous

13.1. The Company may change its general terms and conditions of sales at any time. The general conditions in force at the time of order of the Products will apply to the Contract between the Customer and the Company.

13.2. Without prejudice to any of the rights and remedies granted to the Customer by the applicable law or these Terms and Conditions, our liability for direct damage will be limited to the value of the Products ordered.

Any package delivered by the company is not exchangeable or refundable.
