Article 1 – Definitions
Customer: Any natural person who acts for purposes that do not fall within their commercial, corporate, craft or professional activities and who buys or will potentially buy Products via the Website.
Contract: The distance contract concluded between the Company and the Customer for the purchase of Products via the Website. The Contract is governed by these general conditions.
Working day: Every day except Saturday, Sunday and Belgian public holidays.
Offer: The offer of Products via the Website. The Offer is governed by these general terms and conditions.
Products: All products available for purchase on the Website.
Website: The Mo'vintage website.
Company: Mo'vintage incorporated under Belgian law whose registered office is located at 8 rue de la gare 7640 Maubray (Belgium) and VAT number 0775.734.932
Article 2 – Object
2.1 Mo'vintage through its movintage.be website offers second-hand clothing and accessories for sale. Each product is inspected to provide customers with an item free of signs of wear. However, some defects may escape control during inspection. The sizes indicated in the summary of each article are those present on the label if the product has one and, if necessary, an estimate will be made by the company. To avoid any confusion, the customer can find the measurements of the article in the description of the latter.
2.2. The customer will receive the item(s) he has ordered as they are published on the site. However, a slight color difference is possible depending on the light.
2.3. Each piece on the site is present in only one copy.
2.4.The company makes every effort not to sell counterfeit items. However, counterfeiting is a growing phenomenon and some clues may escape us.
2.5. The customer will only receive the clothing as detailed in the description. The different elements present in the photos serve as decoration.
Article 3 – Applicability
3.1. These general terms and conditions apply to each Offer of the Company and to all Contracts.
3.2. These general conditions will be made available to the Client before the conclusion of the Contract between the Company and the Client. These general terms and conditions will be made available to the Customer, at least before the conclusion of the Agreement, in a way that allows him to save them on a durable electronic data carrier.
3.3 Any order placed on the movintage.be site indicates acceptance of the General Terms and Conditions of Sale. Any order confirmation entails your full acceptance of these general conditions of sale, without exception or reservation.
Article 4 – Formation and duration of the Contract
1- The customer goes to the movintage.be website (Clothing (movintage.be)
2- The customer reads and accepts the general conditions of sale.
3- The customer selects the desired products and these are automatically added to the shopping cart.
4- When the customer finishes selecting the products, he can then move on to the next step by pressing the “Order” command.
5- The customer will arrive on the "Basket" page where he can optionally insert a promo code and then go to the next step by pressing the "order" command
6- The customer can make the purchase of his order by connecting to his personal Mo'vintage account or as a guest.
7- The customer fills in the details requested for the order and presses “continue”.
8- The customer fills in the information requested for the delivery address and presses "continue"
9- The customer indicates the means of delivery by which he would like the company to send him the package and presses "continue"
10- The customer chooses the method of payment with which he wishes to pay for his order.
11- The customer makes the payment. The order is finalized.
4.1. The Contract is concluded from the moment the Client has accepted the Offer and the general conditions.
4.2. The Contract and the general conditions will remain in force until the fulfillment of all obligations.
Article 5 – price
5.1. The prices of the Products will be those indicated on the Website at the time the Customer places an order.
5.2. Movintage.be reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the price in force at the time of the validation of the order. The products remain the property of Movintage.be until full payment of the price.
5.2. All prices include VAT at the current rate applicable in Belgium.
5.3. All Product prices are exclusive of delivery charges. Delivery costs are the responsibility of the customer. Delivery costs will depend on the country where the Products are to be sent.
5.4. Prior to the submission of an order, the total price, all costs and taxes included, will be made available to the Customer and indicated in euros
5.5. The order will not be processed until the Company has received the Customer's instructions within 48 hours. If the Company fails to contact the Customer using the contact details provided by him during the order process or if the Company does not receive any response from the Customer within the aforementioned period, it will treat the order as canceled and notify the Customer in writing.
Article 6 – Payment and means of payment
6.1. The Customer may use the following means of payment to pay for the Products: Bancontact, Visa and Mastercard.
6.2. The Customer must pay when ordering.
Article 7 – Shipping and delivery
7.1. The Company undertakes to deliver the Products within 1 to 7 working days depending on the shipping method after receipt of full payment. If the Company is unable to deliver the Products within the aforementioned period, it undertakes to inform the Customer in writing. In this case, the Customer will communicate to the Company a new delivery time which must be reasonable. If the Company does not respect this new deadline, the Customer has the right to cancel the order.
7.2. (Option) The Customer will receive a confirmation via email as soon as the order leaves the premises of the Company. The confirmation will contain all the necessary information regarding the delivery method.
7.3. The Company will deliver the order to the address provided by the Customer during the purchase process.
7.4. If no one is present at the Customer's address at the time of delivery, the Customer must follow the instructions of the delivery service responsible for delivering the order.
7.5 The Company is not responsible for damage caused during delivery.
Article 8 – Right to cancel an order before delivery
8.1. The Customer has the right to cancel the order without reason and free of charge before it is dispatched.
8.2. The Customer can cancel the order by sending an email to contact@movintage.be. After the cancellation of the order, the Customer will receive a confirmation of the cancellation by e-mail and the Company will refund the amounts already paid to the credit or debit card used by the Customer to pay.
8.3. After receiving confirmation that the Products have left the Company's premises (in accordance with article 7.2.), the Customer can no longer cancel the order.
8.4. If the order could not be cancelled, the Products will be delivered and the Customer may return the Product according to the procedure provided for in Article 9.
Article 9 – Right of withdrawal and reimbursement
9.1. The Customer has the legal right to withdraw from the Contract during the period provided for in article 9.2. This means that the Customer may decide, during the period concerned, not to keep the Products. The Customer must inform the Company of its decision to withdraw and will receive a refund. The Customer does not have to justify his withdrawal.
9.2. The customer has 14 days to withdraw from the contract. The start date of the withdrawal period begins from the receipt of the package by the customer.
9.3. The customer must inform the company either via the messaging service integrated into Mo'vintage or by email at the following address: contact@movintage.be
9.4. The customer must close the package with all the products delivered to him. This includes the item(s) purchased as well as the secondary accessories offered by the company. If the package is not complete, the refund will only be partial.
9.5. The package must be returned to the registered office of the company. Return costs are the responsibility of the customer.
9.6. The refund will be made upon receipt of the package by the company. Refund processing may take up to 10 business days.
9.7. The refund includes the price of the item(s) as well as the delivery costs of the first shipment of the order
9.8. If the customer wishes a partial return of his order, he must follow the same withdrawal process explained above. (Explanation from point 9.1 to point 9.7). However, the company undertakes to reimburse only 50% of the delivery costs of the first shipment. Return costs are the responsibility of the customer.
Article 10 – Complaints procedure
10.1. In the event of a complaint from the Customer, the latter may contact the Company at the e-mail address contact@movintage.be
Article 11 – Use of personal data
11.1. The Company only uses Customer's personal information in accordance with the Website's Privacy Policy.
Article 12 – Applicable law
12.1. These general conditions are written in French. This means that Contracts relating to the purchase of Products through our Website and any dispute or claim arising out of or in connection therewith shall be governed by Belgian law.
Article 13 – Miscellaneous
13.1. The Company may modify its general conditions of sale at any time. The general conditions in force at the time of the order of the Products will apply to the Contract between the Customer and the Company.
13.2. Without prejudice to any of the rights and remedies granted to the Customer by applicable law or these general conditions, our liability for direct damages shall be limited to the value of the Products ordered.
Articles 14 - Hand delivery
Any parcel delivered by hand by the company is neither exchangeable nor refundable.
